Emotion and Law

In recent news there is mayhem as to why some persons have been granted presidential pardon. Some people are very much angered by this event whiles others are over joyed and organizing parties all over because their heart desire have been met.

I have listened well enough to know what this whole brouhaha is about in that these persons were accused of contempt of the supreme court by treating the lives of some supreme court judges and the 4th PERSON of the country thus the Chief Justice of this country.

They were then sentenced by these same justices to 4 months in prison. This called for some of their ‘followers’ to petition the sitting president to used his powers granted him by the highest Law of the land to release them.

The Law states under the Prerogative Of Mercy Article 72 section 1 says ‘The president may , acting in consultation with the Council of State- (a) grant to a person convicted of an offense a pardon either free or subject to lawful conditions; or (b) grant to a person a respite, either indefinite or for a specified period, from the executive of punishment imposed on him for an offense; or (c) substitute a less severe form of punishment for a punishment imposed on a person for an offense; or (d) remit the whole or part of a punishment imposed a person or of a penalty or forfeiture otherwise due to Government on account of an offense.’

The President of Ghana John Dramani Mahama granted pardon to these persons based on the Powers vested in him by the laws of the land.

Other persons who have criticized the President negatively are of the view that he has undermined the judgment of the supreme court judges thus judgement of the highest court of the land. In my candid opinion right from the start i was of the view that these persons were to be given more months and even years so as to help correct the politics of insults. In Burkina Faso one of their Ministers who went to out source for funds for his country was told to go back and denied the funds due to some statements he had made earlier saying that all politicians are thieves. In view of this I had wanted this case to help correct the was we treat our leaders in this country. These people are of the view that as this has been done the judiciary might not be respected again and also other persons can go on the airwaves and say whatever they like since they know in the long-run they can be pardon if sentenced.

The President and the Cabinet also pardoned these guys because of the remorse they showed and have been showing since the court case began. I think as a father of the land he visioned the troubles and grieve their families might have been going through. Also he and his Cabinet saw the plight of most people seeking them pardoned on the basis of first time offenders and remorse shown.
